A judge forces a Ryanair employee fired after a strike to be reinstated

Date: July 12, 2024 Time: 22:31:08

A court in Santiago de Compostela has forced the reinstatement of a Ryanair cabin crew member who was fired during last year’s strike. The court considered that she violated her fundamental right to second strikes. In a sentence of the social court number 2 of Santiago de Compostela on August 10, to which Efe has had access, he completely agrees with the worker and sentences Ryanair to pay her 7,501 euros as compensation, in addition to wages. from the date of dismissal, August 16, 2022.

What happened was that during the crew strike in the summer of 2022, Ryanair made a disciplinary dismissal against this worker, as it did with more people in a similar situation. The sentence states that in that strike Ryanair imposed minimum services with continuous changes to try to guarantee 100% of the services, for which it would resort to these modifications in the function of daily operations.

The dismissal refuses to accept flight changes in the minimum services assigned during several days of the strike. “Any activity that involves a reorganization of work, in the sense of temporary internal substitutions, voids the right to strike,” the ruling explains. In this situation, “the worker who avails himself of the right to strike is obliged to be obliged and forced to comply with a business order, because if this is not the case, he may be fired, as was the case with the plaintiff.”

“This way of acting by the company makes it almost impossible to exercise the right to strike”

“This way of acting by the company makes it almost impossible to exercise the right to strike, giving priority to business activity over constitutional law,” he continues. For this reason, he understands that a fundamental right has been violated and the dismissal must be void, with reinstatement of the plaintiff. The judgment is not final, since it is possible to file an appeal against it before the Superior Court of Xustiza in Galicia.

The USO union, which promoted that strike, positively values this sentence through a statement and explains that it is the first linked to those strikes. add that there are close to fifty similar lawsuits filed against the “business model based on the abuse of workers and passengers” of which Ryanair is accused.
