A Kaliningrad resident lost the apartment in which she lived for more than 20 years – Rossiyskaya Gazeta

The history of the apartment on Yuri Kostikov Street is very confusing. The parents of Mikhail Konosheidov, Victoria’s husband, moved there in 1959. There was a time when Mikhail got married, a daughter was born, and the whole family continued to live in the same apartment. And then she got divorced. His ex-wife and her daughter moved to another apartment. So – a new marriage.

– Mikhail and I started living together in 2001. Then I moved to a house on Yuri Kostikov Street. Five years later they got married, after which they lived married until 2022. Unfortunately, Mikhail died and I was left alone, ”Victoria Shadrova shared her story.

The couple lived like many Russian families: they put their salaries “on a nightstand”, Victoria worked and took care of the house: she cooked, washed and cleaned. In 2005, Victoria’s father-in-law died after an illness and two years later, her mother-in-law passed away. Mikhail worked as a driver in a bakery until 2012, then he retired and almost immediately suffered two strokes in a row. Shadrova had to leave her job to take care of him. According to her, her husband’s daughter did not communicate with the family and did not provide any help to her father, so Victoria shouldered the burden alone.

– There was not enough money for treatment, so I sold a part of our family apartment in Kaliningrad, in a neighboring house on Yuri Kostikov Street. All proceeds went to caring for my husband. “I still have my medical documents,” the woman noted.

Caring for his wife helped: Mikhail came to his senses, but, unfortunately, he became addicted to alcohol, which negatively affected the health of a man who had suffered two strokes. In 2018 he fell and broke his hip, after which he was confined to a wheelchair, and four years later he was gone.

That’s when the problems started. Mikhail’s daughter appealed to the administration with a request to renew the social rental contract for a municipal apartment in her name. The authorities reviewed it and made changes to the documents. Having received housing at her disposal, the woman filed a lawsuit for the forced eviction of Shadrova.

The fact is that Victoria lived in an apartment on Yuri Kostikov Street practically “with bird rights.” She was not registered there nor did she receive written consent from her family to move there. It was the lack of this consent that perhaps became the main argument of the court when making a decision on the eviction. It didn’t even help that this was Victoria’s only home. She and her first husband sold the first apartment in which she owned shares in the ’90s. They also decided to sell the living space, which was inherited from Victoria’s mother and her sister. Shadrova spent the money she received on Mikhail’s treatment for the consequences of strokes.

– The court said that the eviction does not deprive me of the right to housing, since I can apply to the administration if I need housing. This decision was confirmed by the appeal and cassation courts. The bailiffs have already demanded that I voluntarily leave the apartment. But I have nowhere to go. I work as a dishwasher in a cafe and my salary is small, so I don’t have money to buy a new apartment. I will try to get justice in the Supreme Court of the Russian Federation, where I filed an appeal,” Victoria concluded.

From a legal point of view, the story was complex. In fact, the obstacle was the issue of succession and the lack of supporting documents that could convince the court of the legality of the heroin material found in the disputed apartment.

Victoria tried through the court to recognize herself as a member of the employer’s family, but her attempts were in vain. And Mikhail Konosheidov’s daughter is a member of the family and could apply for living space. This was reported by the Kaliningrad administration in response to a request from RG.

The wife was never searched in her husband’s apartment.

– The tenant of the apartment was Mikhail Konosheidov’s father. After his death, any capable member of the family could apply to the administration to renew the social tenancy agreement they had with him. The granddaughter did it in December 2022. Victoria Shadrova was never registered in apartment number 2 of building number 18 on Yuri Kostikov Street. The marriage between her and the employer’s son took place in 2006, after the death of Mikhail Fedorovich Konosheidov. As a result, Shadrova was not related to the employer, the department said.

The only option to solve an elderly woman’s housing problem, the administration is convinced, is to register and get in the queue of those who need housing. However, getting housing under this scheme can take years and Victoria needs to live somewhere now. RG will continue to monitor the situation.

Meanwhile

Kaliningrad lawyers are convinced that Victoria Shadrova’s case is not lost and that the Supreme Court of the Russian Federation can side with her.

– For some reason, the court did not take into account the expiration of the limitation period in this case, which is three years. After all, Mikhail Konosheidov’s daughter found out that Shadrova was living with her father in 2001, and her grandfather’s employer died in 2005,” explained Kaliningrad lawyer Natalia Lenskaya. – That is, for eight years the apartment legally had no tenant.

The rights of the granddaughter of Konosheidov and Victoria Shadrova to the apartment derive from the right of the tenant, the lawyer adds. Legally, they have the same status: wife and daughter of the same man. And the mere fact of registering in an apartment does not affect the emergence of rights to housing.
