One of the proposed innovations is that state law firms and lawyers will be able to provide free legal assistance, representing the interests of orphans in inheritance cases in court.
“The bill is aimed at improving legal guarantees for socially vulnerable citizens,” stressed Vladimir Gruzdev, chairman of the board of directors of the Russian Bar Association. “It is planned to exempt preferential categories entitled to free legal assistance under the state program for the payment of the state fee for notarization for the representation of interests in court”.
He recalled that the State is currently actively developing free legal aid programs. One of the forms of such interaction is the representation of citizens’ interests by lawyers or solicitors in courts and state bodies. However, in such cases, a mandatory power of attorney is required to represent interests. The execution of this document is now expected at the expense of the own funds of the principals. At the same time, it should be noted that the preferential categories include citizens for whom the cost of granting power creates a significant financial burden. This may well become an obstacle to your appeal for the protection of your rights. There are cases where lawyers paid the fees of citizens at their expense.
“The initiative allows you to solve the financial problem, so that it does not become a restrictive factor for citizens who benefit from receiving state legal assistance measures. It should be remembered that the Russian Ministry of Justice is now actively working on the development of a system of free state legal aid. Legal education and free legal aid programs are also priorities for the AJR”, summed up Vladimir Gruzdev.
By the way, notaries also have their own preferential programs. The total amount of benefits provided by notaries to Russian citizens exceeds 2.7 billion rubles a year.
