The story that ended yesterday in Rome dates back to 2018, when an ordinary couple from Milan unexpectedly received a summons from the Juvenile Court. What was the surprise of the Italians when they learned that the husband’s parents and her uncle had filed a lawsuit against them, demanding that Themis’s servants force “negligent relatives” to give them the opportunity to see their grandchildren. In general, young Milanese would not be against such communication, if it were not for one “but”: a serious mental illness of her grandmother. At the time of the attacks, she could pose a real danger to the children.

It is important to note that, since 2006, Italian family law allows family members to file such claims. Thus, “a child has the right to maintain relationships with his grandparents, even if his parents have separated.”

It was this provision that guided the Milan judges in 2019, when making their decision on the really forced visits of the children with their grandmother. It is true that the meetings had to be held in the presence of a social pedagogue and on the condition that the old woman was assisted by a psychiatrist who would guarantee the continuity of the treatment. The last point, however, was annulled by the Milan Court of Cassation on the complaint of a woman in the same year, and the almost extinguished family conflict resurfaced with renewed vigor, since the grandmother immediately abandoned therapy.

As a result, the parents’ patience ran out and they appealed to the Italian Supreme Court of Cassation with a lawsuit to resolve the legal discrepancies, writes the daily La Repubblica.

In their decision, the stoats (as the presidents of the Supreme Court in Italy are popularly known) stated that while there is no doubt that “two children would benefit from being connected to the older generation”, they should not be forced to watch their older relatives. especially in times of conflict.

Therefore, the Court ruled that the best interest of the children must prevail over that of the grandparents, and that “undesirable relationships” cannot be imposed, even more so if the children were of an age at which “they are in a position to judge for themselves the nature of relationships in the family and their own sympathy”. In addition, the judges took into account the persistence of the aggressive attitude of the grandparents towards the parents of the children.

Now the Milan court will have to reconsider its decision in light of the new circumstances.
