According to the 43-year-old beauty pageant contestant, doctors disfigured her face and caused her suffering, and she spent even more money on rehabilitation.
Initially, the actions of the defendant were qualified in paragraph “c” of Part 2 of Article 238 of the Criminal Code of the Russian Federation “Provision of services that do not meet the requirements of health safety of consumers, if due to negligence they resulted in the infliction of serious harm to health”. However, then, at the request of the prosecutor, the case began to be considered under Part 2 of Article 118 of the Criminal Code of the Russian Federation “Causing serious harm to health due to negligence, committed as a result of improper action by a person “of their professional duties”, which was explained by the lack of intentionality.
The accused did not admit his guilt. The court sentenced him to a restriction of freedom of three years, but due to the statute of limitations he was released from the sentence. The ruling has not yet come into force. Let us remember that last year the same court partially upheld the author’s claim, in whose favor the clinic collected 3 million rubles as compensation for moral damage and 1.5 million as a fine.
