A 53-year-old resident of the Penza region, owner of an LLC, invited an acquaintance to temporarily become the sole founder of his agricultural organization. The purpose of this was to obtain a loan, and since his credit history as the owner of the company was negative, he could not obtain credit loans. The men agreed that the previous owner would manage the activities of the organization.
“After some time, the current head of the organization, no longer needing the help of the accused, demanded the return of the company. The men signed a purchase and sale agreement, but the victim did not control the entry of data on the company. The change of the founder in the Unified State Register of Legal Entities,” reports the press service of the FSB Directorate for the Penza region.
Taking advantage of this, the suspect hired a dummy and, promising a reward of 50 thousand rubles, entered information about him as the sole founder into the Unified State Register of Legal Entities.
In October 2022, in order to take possession of the company’s property, the suspect entered into a purchase and sale agreement with a new fictitious manager to acquire a 100% stake in the company’s authorized capital. The amount of damage caused as a result of these actions is estimated at 935 million rubles.
A criminal case has been initiated against the suspect involved in the commission of the crime under Art. 159 of the Criminal Code of Russia “Fraud” and Art. 173.1 of the Criminal Code of Russia “Illegal formation (creation, reorganization) of a legal entity”. The materials of the criminal case have been transferred to the court.
