Justice upholds acquittal of sculptor who painted Franco’s tomb

High Court of MadridTSZHM) confirmed the acquittal of the sculptor Enrique Tenreiro, who painted the dictator’s tombstone Francisco Franco when he was still in Valley of the Fallen. Accused of violating freedom of conscience and religious feelings, Provincial Court of Madrid already acquitted him of his crimes, but Valley Defense Association repeated. This Thursday, TSJM denied the appeal.

The events took place on October 31, 2018, when the artist painted a dove and wrote “For Freedom” on the grave of the dictator. The action was recorded and broadcast on social networks by a photographer, Peter Armestrewho claimed that Tenreiro acted “to reconcile the Spaniards”.

The court of Madrid emphasized in the judgment that Tenreiro did not enter any church, but rather the one where Franco’s tomb was located, so that “it is clear that this was contrary to his presence in this place, and not to the religious feelings of the assistants.” there”. TSZHM considers that the verdict contained a “free, rational and motivated assessment” and that the sculptor’s actions “were not motivated by the evil aim of hindering the celebration of the mass, which had not even begun and which, in any case, was delayed for a few moments”, according to Efe.

The association requested in its appeal two years and five months in prison for the artist, but Tenreiro stated that I didn’t mean to interrupt mass and that, in fact, he rushed to paint the gravestone when he saw that it was about to begin. Madrid’s Supreme Court adds that there was no violent, intimidating or noisy cult intrusion necessary to assess the crime.
