The Ministry of Ecological Transition and for the Demographic Challenge has issued an order with the aim of creating an anti-fraud measures unit within it. The portfolio plan directed by Teresa Ribera is intended to control the projects associated with her department that are financed with European funds from the Recovery Plan.
In the order, published this Tuesday in the Official State Gazette (BOE) and collected by Europa Press, it is recalled that any entity, decision-maker or executor, that participates in the execution of the Recovery Plan measures must necessarily have a plan of anti-fraud measures that allows it to guarantee and declare that, in its respective field of action, the corresponding funds have been used in accordance with the applicable regulations, in particular, with regard to the prevention, detection and cleaning up of fraud , corruption and conflicts of interest.
In compliance with said mandate, the Ministry for the Ecological Transition and the Demographic Challenge has prepared, through its Undersecretariat, a plan of anti-fraud measures, prevention of conflicts of interest, absence of double financing and adaptation of the State aid regime for the management of all projects financed by European funds.
This plan defines the main actions that must be taken to prevent misuse or fraud in the financial resources of the Recovery Plan in order to prevent, detect and establish corrective measures so that financial resources from the European Union are not waste and meet the fines for which they are assigned.
“The aforementioned plan is configured as a living and flexible planning instrument, which allows its modification through new instructions, regulations or guides for the preparation of these plans, as well as maintaining a continuous review of each of the planned measures in the fight against fraud for its improvement”, explains the Ministry.
The application of this plan provides for the creation of an anti-fraud measures unit to promote and coordinate the planned prevention, detection, correction and prosecution measures. By virtue of the order published today in the BOE, in force as of tomorrow, said unit is constituted and regulated, the purpose of which is to coordinate the organic units of the Ministry that participate in the management and execution of the Recovery Plan for the application of the plan for anti-fraud measures, prevention of conflicts of interest, absence of double financing and adaptation of the State aid regime of the Ministry for the Ecological Transition and the Demographic Challenge.
The unit, which will meet on a quarterly basis, will have among its functions to propose the creation of a control system that allows knowing and reporting all the controls carried out, both by national and community organizations; proponent of carrying out controls on various aspects of the execution of the Plan; approve the control plan for each period and promote them; Identify problems and propose corrective measures.
The Ministry specifies that this unit of anti-fraud measures will be assisted by personnel belonging to the temporary unit for the execution of the Recovery Plan attached to the Undersecretariat for the Ecological Transition and the Demographic Challenge, therefore it will not lead to an increase in public spending.
