The opinions to Administrative Assistant of the State 2023 are about to candy. And it is that on January 27 the BOE published one of the largest public employment offers in the history of our country to work as a public official. The Government of Spain, at the request of the Ministry of Finance and Public Function, led today by Minister María Jesús Montero, raised the salary of civil servants by 2.5% for this year, which also includes a clause of Salary review based on the CPI, which represents a salary increase of 9.5% between 2022 and 2024, which is included in the 2023 General State Budget.

Two new salary supplements
The Government entered in December 2022 the draft law of the Civil Service, one of the great reforms and novelties contemplated in the Recovery, Transformation and Resilience Plan (PRTP). In this regulation, pending approval, two new salary supplements are contemplated for public employees, based on their performance evaluation and professional evolution. However, it does not seem that the Executive of Pedro Sánchez has all the consequences.
The CCOO and UGT unions have reported that they have presented up to 250 modifications to the draft Civil Service Law, and, in addition, they have claimed to have achieved “significant progress” in the four meetings held. Comisiones Obreras denounces that the current bill “reduces consolidated rights of public personnel.”
How will the performance of a public employee be measured?
If the new Civil Service law is approved, it would allow civil servants who have obtained their position through opposition to be removed from their job if they do not perform their tasks correctly, if their performance is insufficient or if they can only be requested for the job. post . This evaluation will begin six months after joining the job. In the event that the employee must be removed for any of these reasons, he will be temporarily transferred to another Administration position according to his career, in the same location where he performed the previous function.
Precisely in this sense, the offenses committed by civil servants in the exercise of their duties could be classified as minor, serious and very serious, which would imply a penalty that could determine the suspension of the service of a career civil servant.
Among them are some such as abandonment of the service, the notorious breach of essential functions, negligence in the custody of official secrets or open disobedience to the orders or instructions of a superior, all determined in article 95 of the Royal Legislative Decree. 5/2015.
The most serious have to do with the breach of the duty to respect the Constitution and the respective statutes of Autonomy; discrimination based on racial or ethnic origin, religion or belief, disability, age or sexual orientation; the abandonment of the service; the adoption of illegal agreements; the publication or improper use of the documentation or information to which they will have or have had access due to their position or function; and breach of impartiality.
