“If you have not found information about the land under your house on the Public Cadastral Map, the following reasons are possible for the land not being on the map: no land survey has been carried out (the land has been formed, but its boundaries have not been established); the land for the apartment building has not been formed,” Gavrilov explained.
In both cases, it will be necessary to call a cadastral engineer, who will then prepare a boundary plan and make a boundary diagram, explained the deputy. Then, the site must be registered in the cadastral register. “Without this, it will not be possible to legally install a barrier,” he concluded.
Check installation capacity
It is also important to understand whether it is technically possible to install a barrier. “That is, it is impossible for a barrier to interfere with the movement of pedestrians, and in no case should it block their only path,” explained the head of the commission. “It is impossible for communications to pass under the barrier. It is impossible for it to interfere with the route of even the largest transport (for example, a fire truck or not necessarily special equipment, but simply a large truck that must pass through its dimensions calmly).”
In addition, according to him, there are requirements for barriers in the form of light symbols, special signaling elements, requirements for the strength of the structure itself and the mechanism. “If they are not respected, the barrier is dangerous for people, technically unsafe for transportation and must be torn down,” the MP warned. “The malfunction of the barrier must be urgently corrected.”

If all the documents are in order, it is technically possible to install a barrier that meets all safety requirements, then to install it you need to obtain 2/3 of the votes of the general meeting of owners of an apartment building. The fact is that it is not only a question of the use of common property, but also of collecting money, which must also be approved at the meeting, Gavrilov explained. According to him, it is necessary to send notices to the traffic police and the Ministry of Emergency Situations about the planned installation of a barrier.
Next, along with all site documents, minutes of general meetings and estimates and copies of notices, you must contact the local administration to obtain permission.
“You cannot simply install a barrier yourself without permits. It is subject to dismantling and at the same time a fine is imposed on the management company, if the responsibility for maintaining and keeping the structure in good condition was assigned to it or to the Homeowners Association. They will have to pay a fine,” the head of the committee described the consequences of ignoring the rules.
