The Prosecutor General’s Office has tightened control over the new child allowance and clarified when the denial of payments is a violation – Rossiyskaya Gazeta

As reported to the RG correspondent in the Attorney General’s Office, in relation to the reforms to the Federal Law “On State Benefits for Citizens with Children”, in the regions, as of January 1, 2023, the payment of a single monthly payment in concept with the birth and upbringing of a child began.

The supervisory body recalled that this subsidy accumulates a series of social support measures, including a monthly subsidy for pregnant women, a subsidy for the care of a child, monthly payments for a child from 3 to 7 years old and from 8 to 17 years, as well as regional benefits for children.

The Office of the Attorney General of the Nation instructed the regional prosecutors to work to guarantee the legality, integrity and timeliness of the allocation of this subsidy to needy families.

In addition, the control body “RG” ruled on the most typical violations of the rights of children and their parents, when officials unjustifiably deny them due payments.

For example, in the Adygea, Kalmykia, Tatarstan, Altai, Stavropol, Voronezh, Kemerovo, Kirov, Kostroma, Samara and Moscow regions, prosecutors challenged illegal refusals to allocate social payments to families whose average per capita income and security of property were assessed incorrectly. So, only in the Tomsk region, after the prosecutor’s intervention, more than 15 families received benefits, which were not unreasonably assigned with reference to the alleged possession of two or more cars. According to the prosecutor’s office, such a “confusion” occurred, among other things, due to the improper organization of interdepartmental interaction.

In the Oriol region, at the request of the prosecutor, in court, the head of the farm recognized the right to receive a monthly payment for a child between 3 and 7 years of age. The audit showed that the plaintiff is applying a special tax regime in the form of a single agricultural tax, in which the tax base is the income from the farm, less the amount of the expenses. At the same time, the family’s level of financial security was incorrectly assessed by the population’s social protection agency based on the entire income of the billing period. As a result, after the recalculation of the family income according to the tax base of the farm, the right to social benefits was confirmed.

In Blagoveshchensk, the rights of a family to receive a similar payment were restored, the average per capita income of which was calculated taking into account the income of the spouse, which he received before marriage.

Prosecutors also identified numerous cases of illegal denials of social payments with reference to the absence of parental or child registration at the place of residence in the region. At the initiative of prosecutors, the rights of families of the Krasnoyarsk Territory, Moscow, Novosibirsk, Orel, Yaroslavl regions, Moscow, the Yamalo-Nenets Autonomous District and other regions were restored in court by confirming the fact of their permanent residence in these territories. .
