The Council of Ministers has already approved the draft of the new Family Law that has been promoted by the Ministry of Social Rights and the 2030 Agenda, whose leadership is led by Ione Belarra, member of the state citizen council of Podemos. However, for this new regulation to come into force, the corresponding parliamentary procedure must have been carried out and completed before the Cortes have been dissolved within a year, since the general elections will be held.
In principle, the text preserves the provisions that they will obtain from the first day of the year 2021, for the birth permit and care of the minor are equalized for both parents so that they can enjoy 16 weeks of benefit, in accordance with the Royal Decree Law of urgent measures to guarantee equal treatment and opportunities between women and men in employment and occupation, approved in March 2019.
On the other hand, one of the most noteworthy aspects is that the parents (who have also been defined as the “non-pregnant parent”, according to the conceptions preached by the purple gender identity party) will be able to “anticipate in ten days the beginning of the enjoyment of the leave” of paternity. of the text, which otherwise has generated controversy in certain political circles due to the elimination of the concept of the large family in favor of “families with the greatest need for parenting support”.
The flexibility that parents can be notified at work corresponds to the objectives “of caring for the biological mother during this period”, which is why the Workers’ Statute Law is modified.
Prior to the modifications that the Family Law would establish, the Workers’ Statute establishes that “the suspension of the contract of each of the parents for the care of a minor, once the first six weeks immediately after the birth have elapsed, may be distributed to will of those, in weekly periods to enjoy cumulatively or interruptedly and exercise from the end of the mandatory suspension after childbirth until the son or daughter reaches twelve months.
In this sense, it also highlights that “the biological mother may anticipate her exercise up to four weeks before the foreseeable date of delivery.”
The new text will provide that a single father or mother who has a son or daughter with a disability will be entitled to enjoy the full extension of paternity leave that would have corresponded to a family made up of two parents in the same situation, that is, two weeks more
