One of the most important business initiatives is to raise the importance of the “experience” criterion when selecting the successful bidder. Today, the price offered by the participant “weighs” 60 percent, and qualifications and experience – only 40 percent, so those who openly get rid of it win. Sometimes the discount they are willing to accept is fantastic. Thus, in the Irkutsk region there was a case when the contract price was reduced by 80 percent, from 11 to 2 million rubles. In the best case, said object will be delivered very late; In the worst case, it will be abandoned at stage zero and the contract will be terminated.
To exclude such stories, clients turned to federal authorities with a proposal to select contractors for construction lots not at auctions, but only through a competition, where experience is mainly evaluated, rather than price. This is especially important in the creation of social facilities (hospitals, cultural centers, sports complexes, schools) where there are many specific requirements for equipment and facilities.
The companies, in turn, voted in favor of the legislative ban on substituting materials with cheaper analogues during state exams. Today, experts do this at their own discretion, which can affect the quality of the finished building or structure. The logistics of materials from one region to another are also removed from budgets, but remain in contracts and the contractor must bear these costs.
“If the examination greatly underestimates the estimated cost, there are two options: draw a negative conclusion or agree with everything and build at a loss,” says Sergei Makoveev, representative of the contracting company.
Furthermore, his colleagues add, clients are not willing to admit mistakes made in the terms of reference and design documents. For example, the building is administrative and the design includes panels that, in terms of energy efficiency, are suitable only for production workshops. Or the slabs are specified in one size and the openings in another.
Other initiatives include establishing equal liability under the contract. Today, for delaying construction, the contractor pays a fine of 0.1 percent of the total contract amount for each day of delay, and not of the work performed. If the customer is late in payment, the fine will be only one hundredth of a percent for ten days. In practice, these 10 days easily become 180 and companies suffer losses. The businessmen propose making the fines mirror images and limiting the deferral of payment to seven days, similar to 44 federal laws.
