What new fines were introduced for summer residents in 2023 – Rossiyskaya Gazeta

Date: March 28, 2024 Time: 17:29:34

Nikita Yuryevich, how have the rules for frying kebabs and making a fire in summer cottages changed?

Nikita Chaplin: In the new version of the rules of the fire regime, which came into force on March 1 of this year, the conditions for making fire on the site were softened.

When burning dry grass, a metal container should be located on the site at a distance of at least 7.5 meters from buildings, 50 meters from coniferous forest and 15 meters from deciduous forest. And the cleaning zone around should be 5 meters. When cooking on a barbecue, the fire prevention distance to buildings is reduced to 5 meters and the cleaning zone around the container of combustible materials is reduced to 2 meters.

If these rules are not followed, there is always a risk that neighbors will complain and a representative of the Ministry of Emergency Situations can register a violation. I want to warn you that for violation of fire safety requirements, a warning or a fine for citizens from 5,000 to 15,000 rubles is provided. The fine for a repeated violation when lighting a fire in the area is from 12,000 to 20,000 rubles.

If a special fire regime is declared in the region, open fires are generally prohibited. Those who violate this requirement can be fined 10,000 to 20,000 rubles. If, as a result of a fire, someone else’s property is damaged or light or moderate harm to human health is caused, this is already a fine of 40,000-50,000 rubles. If the consequences are more serious, criminal liability ensues.

Can fires be lit on public land or outside of the SNT? Grilled skewers?

Nikita Chaplin: Bonfires are prohibited outside specially designated and equipped places, and more specifically – on public land of settlements, in forests, in fields.

Where to burn the garbage?

Nikita Chaplin: You can burn garbage at your dacha, but not everything and not everywhere. Only by strictly following the rules introduced on March 1, 2023. It is important to know that for improper burning of garbage, as well as for a fire with toxic waste or construction waste at your dacha, the fine for the owner can be from up to 15,000 rubles.

Will there be fines for weeds and parsley?

Nikita Chaplin – since March 2023, new rules have been in force according to which, if a gardener does not remove weeds, he will have to pay a fine of 5 thousand rubles, and owners of agricultural land – up to 500 thousand rubles. .

In the Moscow region, for example, there is a rule according to which if the owner of the site does not remove the Sosnovsky hogweed, he faces a fine of 2,000-5,000 rubles; for officials, such a fine is already from 20,000 to 50,000 rubles; for legal entities – from 150,000 to a million rubles.

Grasses that are not weeds can only be grown on agricultural land. Summer residents are not fined for dandelions.

The introduction of administrative responsibility for the growth of Sosnovsky’s parsley on plots has little effect on its distribution. Therefore, starting this year, local governments are obliged to ensure that there are no thickets of parsley, even on private land.

First, the owner will receive a notification about the need to destroy the plant on the site. If you don’t respond, then local governments will go to work.

The site owner will be obliged to reimburse the municipality for the money spent on the removal of the plant within two months. If the expenses are not reimbursed, the recovery will be made in court.

The works to remove weeds from private lands will be carried out by the municipal institutions dedicated to landscaping in the territory of the municipalities, the same ones that currently eliminate weeds on state and municipal lands.

Methods for removing parsley are the same everywhere, on land of all ownership forms and all categories. The chemical method consists of spraying weeds with herbicides, and the mechanical method consists of mowing the grass with the subsequent harvesting of the plants. The method to be applied in each case is chosen by the institution that carries out the corresponding work.

An invoice for payment of the work will be sent to the land owner in the same manner as claims are submitted in the pre-trial settlement order, at the land owner’s place of record and with a delivery notice.

Another question is how will the workers get to the fenced off areas? According to the rules, all measures to combat hogweed on private land are carried out within the framework of municipal territorial control, and in this case, the owner is obliged to provide access to the site to the inspector and accompanying persons .

Is it possible to build a pond on the territory of SNT?

Nikita Chaplin: On my site, yes. In accordance with article 40 of the Land Code of the Russian Federation, the owner can use for his own needs the common minerals available on the plot, fresh groundwater, as well as ponds, flooded quarries, and also carry out irrigation, drainage, cultural and other recovery works in accordance with the permitted use, build ponds and other bodies of water in accordance with the environmental, construction, sanitary and hygienic and other special requirements established by law.

But as for the pond on common land, here the decision of the members of the general assembly will be needed.

Will I get fined for washing a car at my site?

Nikita Chaplin: On the territory of SNT it is forbidden to wash and repair cars. The fine for this is from 3,000 to 5,000 rubles, and if the soil becomes contaminated after such procedures, the fine will be 10,000 rubles.

What new fines have appeared for summer residents?

Nikita Chaplin: The first is the ban on washing and repairing cars on the territory of SNT, which I already mentioned above. The second is the incorrect installation of an outdoor toilet. The new regulations stipulate that the waste must be in a geometric container at a distance of 8 meters from the well and 12 meters from other buildings. The penalty for violation is from 3,000 to 5,000 rubles.

Another novelty is the increase in fines for parsnip and dead wood. We also talked about this above. If the gardener does not remove weeds, he will have to pay a fine of 5,000 rubles, and the owners of agricultural land – up to 500,000 rubles.

Where can the crops be sold?

Nikita Chaplin: The amendments to the horticulture law have entered into force. Now, by decision of the general assembly, it is possible to lease SNT assets to third parties, which will simplify the sale of their harvest on public land. The new powers will allow the Assembly to resolve issues relating to the organization of fairs and stationary trade.

You can sell the harvest at the farmer’s market. The gardener comes to the bazaar and, if there are free places allocated for trading personal subsidiary plots, he concludes a simplified contract and can start trading.

In addition to markets, there are also social fairs, the information about which is published on the official portal of the local administration. To get a place at such a fair, you need to apply in advance.

You can also sell the harvest at the weekend fair. Unlike social fairs, admission to the site does not require any payment. In such places, you can sell agricultural and food products.
