Let us recall that “participation by appointment” refers to situations where the State provides a lawyer to a person. In such cases, the lawyer’s remuneration is borne by the treasury. At the same time, the defence lawyer remains independent; he is obliged to comply with professional standards, guaranteeing the accused the right to defence.
As of October 1 this year, the remuneration of a lawyer who participates in a criminal process by appointment is expected to be indexed using a coefficient of 1.051.
Thus, in cases tried by a jury – for cases tried before the Supreme Court of Russia – the remuneration will be 2,479 rubles per working day. If the lawyer works at night, the remuneration will be 3,488 rubles. On non-working holidays or weekends, including at night, the remuneration will be 3,863 rubles per day.
In cases involving three or more defendants or in cases where the volume of materials exceeds three volumes, the reward will be 2,226 rubles per day. For cases considered in closed court sessions or outside the relevant court buildings, the remuneration will be 1,978 rubles per day. Etc.
The Chairperson of the Federal Chamber of Lawyers of the Russian Federation Svetlana Volodina noted that the news about the indexation of the amount of remuneration of defense lawyers participating in criminal proceedings appointed by the investigator, the inquirer or the court concerns about 70 percent of practicing lawyers. “These are today’s statistics, of course, we cannot but rejoice that the state, in these difficult times, has found an opportunity to preserve and implement this social guarantee,” she noted.
