Lawyer Alexander Dobrovinsky answered questions about the case against Telegram creator Pavel Durov in France.
– The status of judicial supervision that Durov received. How common is this measure in France?
– There is nothing unusual in this. By the way, I was the only one who immediately said: Pavel will be released under supervision. If the case is not classified as a crime against humanity (for example, a charge of terrorism), then this measure is often assigned to the suspect. That is, he is not required to be confined within four walls under house arrest, or to wear an electronic bracelet, etc. The only thing that is required is to periodically report to police stations.
– Can Durov live anywhere in France under judicial supervision?
– Pavel has complete freedom of movement within the country. Let’s say, he can live for a while in Paris, then move, for example, to St. Tropez and then to another place. Only he is obliged to report his presence to the police everywhere and report to local police stations for registration.
– Can Pavel’s preventive measure be changed?
– Only if he violates the order established for him. For example, he does not report to the police twice for an unjustified reason, or commits other acts subject to punishment.
– And how long will you remain in your supervised status?
– This can take a long time, up to one and a half or two years. It is necessary to form a team of investigators and collect the necessary materials for the prosecution. Lawyers, as expected, will file complaints, protest, insist on some additional formalities, putting the brakes on the investigation. Their requests will have to be answered – all this will take a long time. In general, as far as I can judge from the nature of the charges brought against Durov, experienced defense lawyers have every chance of ruining this case.
– In France, as in the United States for example, are sentences for different charges summarized?
– No, there is no such thing there, so no one will put Pavel in prison for more than a hundred years (as, for example, Trump is facing in the United States). I think that the 20 years reported by the media is also a huge exaggeration.
– Irina Bolgar, who claims to be the mother of Durov’s three children, filed a lawsuit against him: according to her version, Pavel beat her youngest son. Moreover, the violence was committed while the couple was in Paris. The child, Bolgar claims, suffered a concussion. What could Durov face for this charge?
“It’s difficult to judge without knowing all the details of this case. When additional information becomes available, it will be possible to resolve the case.”
