The Ministry of Construction recently noted that special accounts do not show the greatest efficiency and the possibility of abandoning them during major repairs is being considered, according to the letter (available to Rossiyskaya Gazeta).
Currently, according to GIS KH, about 10% of apartment buildings have chosen a special account. The question of whether this procedure for the formation and use of capital repair funds violates the rights of citizens was already considered in 2016, at the insistence of deputies, by the Constitutional Court, which did not recognize this procedure as unconstitutional.
On the contrary, the authors of the letter believe that the ban on special accounts would violate the constitutional rights and freedoms of citizens.
Special accounts have their advantages, they point out: they allow citizens to determine the order of work depending on the degree of importance of their implementation. While regional programs often contain errors and distortions, non-priority work is being carried out. By transferring special accounts to the capital repair fund, you lose the efficiency of using the funds when situations arise that require urgent capital repairs. The cost of materials and work through the overhaul fund is much more expensive than when using funds from special accounts (in practice, the difference between HOA 2021 and 22 is 1.5-2 times); The payment collection rate will decrease, as homeowners will be less interested in timely payment for service that will be provided to them 20 to 30 years from now, the letter lists.
On the contrary, it is necessary to promote the development of special accounts and develop mechanisms for additional financing of work on special accounts through preferential lending, the authors of the letter believe. It is also necessary to reduce the quorum for decisions on major repairs and the use of funds from a special account.
