The “dacha amnesty” has been expanded: which buildings are covered by the new law

The deputies immediately approved in second and third reading a law expanding the effect of the dacha amnesty. Now, using it in a simplified way, it is also possible to register outbuildings located on plots for the construction of individual housing, personal subsidiary plots and gardening.

Until now, the dacha amnesty applied to residential and garden houses located on such plots. The objective of the simplifications is that to register a house under this scheme, only its technical plan is needed (requested from a cadastral engineer). Well, and documents proving ownership of the plot. The standard, non-simplified scheme prescribed in the Civil Code presupposes: it is also necessary to notify local authorities about the start and completion of construction, who must ensure that the construction does not violate any urban planning plan or anything else (according to the dacha amnesty, the house can be searched without prior notice).

What kind of dependencies can we now talk about registering under the dacha amnesty?

Let us remind you: citizens should only register permanent buildings. These are those who have an “inextricable connection to the land,” that is, a capital base. On six hundred square meters of gardens, outbuildings of this type are rarely found: summer residents do not use them. But, for example, in villages where the plots were larger and subsistence farming was seriously practiced, the dependencies could be more serious. At the same time, attempts to honestly register them in accordance with the requirements of modern legislation often turned into hemorrhoids, which is why landowners simply gave up on this matter.

Now these barns, baths, chicken coops, greenhouses, etc. You can register in a simplified way if:

– were registered in the technical or state registry as part of the household before January 1, 2013,

– the owner has property rights to the site.

The dacha amnesty will now also include “two-family” houses built before May 14, 1998. This is a different story. This “blocked development” of villages and townships was popular in the 1960s and 1970s. Modern homeowners face problems, as the dacha amnesty applies to houses designed for one family. According to estimates of the State Duma, there are about 66 thousand “two-apartment” houses in Russia.

The law on further simplifications will come into force after its approval by the Federation Council and the signature of the president.
