We remind you that, according to the Code of Administrative Offenses, a car parked incorrectly must be returned to its owner immediately. But subject to several conditions. That is, if the tow truck with the loaded car does not move, and also if the owner proves that he is the owner of the car and has the right to drive this vehicle to eliminate the violation on the spot.
However, often some car owners do not carry vehicle documents with them. They store them directly in the car. Some even leave their licenses in the car. Furthermore, the vast majority of car owners keep MTPL insurance policies in the cabin of their car. And this is also a document without which you cannot drive. So, to prove your right to the possibility of eliminating the violation on the spot, you will need to present all these documents. But doing this is problematic, since the car is already sealed and sealed. And even though the tow truck has not moved yet, the car owner does not have the opportunity to present all these documents, since they are stamped on the car loaded on the tow truck.
To eliminate this injustice, Yaroslav Nilov proposes to amend the Code of Administrative Offenses. That is, modify part 1.1 of article 27.13 of the Code, according to which the detention of a vehicle ends if the driver can present the necessary documents to drive the vehicle and they are inside the stopped vehicle.
This will keep the car itself, as well as its owner’s time and money, safe and sound. Which is more than relevant in the current market situation.
