The Administrative Court of Sport (TAD) has partially upheld the complaint filed by the Higher Sports Council (CSD) and has agreed this Friday to open a disciplinary file against Luis Rubiales, president of the RFEF, for two serious, not very serious offenses, they report to EFE sources close to the case.
The TAD thus initiates a procedure to sanction Luis Rubiales for two infractions against decorum. Unlike the Government, the court sees no abuse of authority. In this way, the CSD Board of Directors cannot decree the provisional suspension of Luis Rubiales and, in addition, the maximum sanction of disqualification would be two years.
The steps to follow of the CSD
The next measure of the CSD is to urge the TAD to provisionally suspend Rubiales. When the court decides on the merits of the matter, the disqualification of the president of the RFEF could be between one month and two years. Luis Rubiales is already considered pro-service by FIFA for 90 days since last Saturday the 26th for his behavior after the Women’s World Cup in Sydney, in which it was in the mouth of the Spanish international Jenni Hermoso in the delivery of trophies for him Spain triumphed over England and made obscene gestures from the authorities’ box.
Given this suspension, the presidency of the RFEF is occupied on an interim basis by Pedro Rocha, head of the Extremadura Federation. The CSD transferred “a reasoned request” to the TAD for a possible violation of the Sports Law and the Royal Decree on Sports Discipline by Luis Rubiales, specifically articles 76.1.a of the first and 14.h of the second, which refer, respectively, to abuses of authority and notorious and public acts that attend to sporting dignity or decorum.
