Recall that from April 25, 2024, by decision of the Arbitration Court, the activities of the IQ Plastic clinic were suspended for 90 days, and the clinic itself was sealed by bailiffs. It is known that suspension of work for such a long period is one of the most severe types of punishment for a commercial organization. The clinic’s lawyers filed an appeal, which was accepted for consideration. And today the decision of the Ninth Arbitration Court of Appeal appeared.
According to the document, the Court of Appeals annulled the penalty of suspension of activities for 90 days and replaced it with a fine of 100 thousand rubles. The decision also notes that the suspension of activities is an exceptional measure, which is applied only if it is proven that the activity may create a real threat to the life or health of people.
“All violations were eliminated almost immediately. Including the late submission of information to the records of the Uniform State Health Information System. This violation is essentially formal and most of the information was submitted even before the court of first instance made the decision. To date, the clinic has eliminated all existing deficiencies in its work,” a representative of IQ Plastic told KP.RU.
According to the lawyer, the fact that the medical institution had never been subjected to administrative liability during its entire period of activity was taken into account as an extenuating circumstance when sentencing the case.
It should be recalled that earlier it became known that the Moscow Arbitration Court prematurely terminated the administrative suspension of activities in relation to the clinic, as all violations identified by Roszdravnadzor had been eliminated.
“To terminate early, as of 04/07/2024, the execution of the administrative penalty imposed on IQ Plastic LLC by the decision of the Moscow Arbitration Court of April 25, 2024 in the form of administrative suspension of activities for a period of 90 days,” the ruling published on the website of the Arbitration Court says.
The clinic is currently operating normally.
