The Supreme Court (TS) Has Urged the Ministry for the Ecological Transition and Demographic Challenge to Pay Endesa, Naturgy and iberdroDroDroDrOLA THE MALS OF 320 Million DEIROOROS EU Owes Them After Declaring Inapplicable The Social Electricity Bonus Set By The Last Government Of Mariano Rajoy. In separate orders, to which Efe has had access dated in May and June of this year, the Supreme Court urges the Government to proceed with its payment, plus the corresponding legal interest.

Last year, the Supreme Court declared the financing regime of the electric social bonus inapplicable and annulled several articles of the 2017 Royal Decree that regulated this figure, considering that it lacked “objective and reasonable justification” and caused “discriminatory treatment”. Specifically, it declared “the applicability of the financing regime of the social bonus and the co-financing regime with the Public Administrations of those supplies to consumers who will have the condition of severely vulnerable, benefiting from rates of last resort and who are at risk of social exclusion ” . What was established in Law 24/2016 of the Electricity Sector and in Royal Decree-Law 7/2016.

The Supreme Court ruled that there was discriminatory treatment “by not imposing the financing on all electrical companies, but exclusively on the marketing companies without an objective and reasonable justification.” As a result of this decision, it was established that Endesa should be compensated with 152.2 million euros; Naturgy, with 64.2, and Iberdrola, with 103, as compensation for the cost of financing the social bond established by the last government of Mariano Rajoy, although these amounts have not yet been disbursed.
